A somewhat bizarre legal story comes from Germany, where one owner of an expensive supercar managed to register it as an official vehicle and thus avoid paying taxes. The case began when the local tax authorities questioned the status of a Lamborghini Aventador, owned by an independent forensic expert. Tax inspectors expressed doubts about the exclusive business purpose of that vehicle, especially due to the improperly maintained documentation of travel orders.

The whole case ended up at the German Federal Fiscal Court, where the entrepreneur had – as it turned out – valid arguments. The main one was the fact that he privately owns a Ferrari 360 Spider and a Jeep Commander, proving that the Aventador was not for personal pleasure, but, well, for business trips. Despite the deficiencies in the documentation, the court ultimately sided with the entrepreneur, overturning the decision that assumed private use for taxation purposes.
The key argument of the court was not based on the technical specifications of the car or the quality of record keeping, but on the plaintiff’s financial situation. In addition to owning more luxury vehicles for private purposes, the expert proved in court that Lamborghini served him as a marketing tool. Namely, the car was covered with a striking foil with the logo and information about his company, which made the vehicle function as a kind of “moving billboard”. He also used another car, a BMW 740d xDrive, for the same purposes, both of which were still under leasing – which also served as evidence of business use.
Although such a practice may seem wasteful by normal business standards, the court confirmed that entrepreneurs have the freedom to choose the means to promote their business. Therefore, even a Lamborghini Aventador can be recognized as a legitimate official vehicle, provided there is a clear distinction between business and private property – at least in Germany.
